Kevin M. Capuzzi

KEVIN is a partner in the Restructuring and Bankruptcy Group of Benesch in Wilmington, Del., and has more than 15 years of experience representing diverse constituencies in complex bankruptcy proceedings nationwide. He is licensed to practice in Delaware and New Jersey, along with numerous federal courts and the U.S. Supreme Court, but his practice is nationwide. For the past 15 years, he has represented various constituencies, including debtors, trustees, official creditors’ committees, trade creditors, critical vendors, landlords, lenders, and parties to adversary proceedings in bankruptcy proceedings throughout the country. His practice is diverse and includes such high-profile matters as representing the debtors in Reverse Mortgage Investment Trust, the official creditors’ committees in the Los Angeles Dodgers, Hertz Rental Car and Yellow Transportation bankruptcies, and trade creditors and landlords in nearly every retail bankruptcy over the last decade. In addition to his bankruptcy practice, he regularly represents lenders, receivers, and other loan parties in high-dollar real estate disputes and loan workouts.

Kevin is an active member of ABI and NCBJ, for which he serves as Executive Board member of its 2025 NextGen program. He also is active in the Delaware Bankruptcy Inn of Court, is a former adjunct professor at Widener University, where he taught on the topic of legal issues in health care management, and is an affiliated scholar with the Institute of Catholic Bioethics at Saint Joseph’s University, researching and writing on the intersection of law and health care ethics. He is a frequent contributor to NAFTA Watch, and he has been recognized in Chambers USA 2025 with record growth in national and regional rankings. He also has been recognized in Benchmark Litigation’s “40 & Under” list since 2022 and is a Band 4 attorney in Chambers for Delaware Bankruptcy/Restructuring. He was selected for the National Conference of Bankruptcy Judges’ Next Generation Program in 2016.

Outside of bankruptcy and litigation, Kevin maintains an active pro bono practice, representing children as a guardian ad litem on behalf of the Delaware Volunteer Legal Services and the Office of the Child Advocate in the Delaware Bankruptcy Court and Family Court. He also has provided pro bono legal counsel for individuals from low-income communities. Within his firm, he mentors younger associates.
