Bethany D. Simmons
Loeb & Loeb LLP, New York, NYBETHANY is a partner in the Bankruptcy, Restructuring & Creditors’ Rights Group of Loeb & Loeb LLP in New York, where she represents clients in all aspects of chapter 11 bankruptcies, out-of-court restructurings and commercial litigation. She also is a strategic partner in the firm’s Real Estate Investments & Transactions department and Luxury Brands industry group. With a focus on implementing strategies to manage and address complex financial situations, she represents clients across multiple industries — including real estate, retail, luxury brands, entertainment, health care, technology, and oil and gas. She plays an active role in every phase of the chapter 11 bankruptcy process, assisting clients with emergency requests for relief at the outset of a case, relief from the automatic stay, asset sales, debtor-in-possession financing, use of cash collateral, contract assumption and rejection, plan negotiation and confirmation, and claim objections. Her representations regularly involve high-stakes contested matters, adversary proceedings and appeals. She also frequently counsels clients seeking out-of-court resolutions.
In addition to her restructuring work, Bethany has extensive litigation experience in federal and state courts. She handles a broad range of sophisticated commercial disputes, including breach of fiduciary duty and other business torts, breach of contract, misappropriation of trade secrets, fraudulent conveyance and preference actions. She also takes a leading role in jury and bench trials, guiding cases from pre-suit demand to final decision. She frequently writes on restructuring topics, with a quarterly column published by Reuters and Westlaw Today, and she is a contributing author for Law360. She also regularly contributes to the firm’s Quick Takes posts, providing insights and analyses about recent notable bankruptcy-related decisions. Admitted to practice in New York and Pennsylvania, she was named in The Legal 500 US in Life Sciences in 2025. She is a member of ABI, the Online Programming Committee of the Turnaround Management Association’s New York Chapter, and the International Women’s Insolvency & Restructuring Confederation.
Bethany discovered her passion for insolvency at Hofstra, where a bankruptcy course sparked her appreciation for Code-based law and the unique blend of transactional and litigation work in the field. A summer associate role positioned her for a career in restructuring. She is deeply committed to giving back through her pro bono work, for which she was awarded her firm’s 2021 pro bono award. She also volunteers with Just the Beginning, for which she reviews applications and mentors 1L and 2L students from disadvantaged backgrounds as they pursue judicial internships. Within her firm, she chaired its associates committee before she was made partner, and she continues that initiative to train and mentor junior associates by holding weekly meetings to share feedback and discuss workload, practice pointers and business-development strategies.
